Welcome to WallGlobe! These Terms of Service ("Terms") govern your access to and use of the WallGlobe website (the "Website") and all services offered through it (collectively, the "Services"). Please read these Terms carefully before using our Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Acceptance of Terms

By accessing or using the WallGlobe Website and Services, you represent and warrant that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms. In that case, "you" and "your" will refer to that organization.

2. Description of Services

WallGlobe provides a platform for users to browse, download, and (if applicable) upload digital wallpapers for personal, non-commercial use. We offer a curated selection of high-quality images.

3. User Accounts (Optional - Include if you have user accounts)

  • Account Creation: To access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify WallGlobe immediately of any unauthorized use of your account or any other breach of security. WallGlobe will not be liable for any loss or damage arising from your failure to comply with this section.
  • Account Termination: WallGlobe reserves the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms.

4. Use of the Services

  • Permitted Use: You may use the Services only for lawful purposes and in accordance with these Terms. You agree to use the wallpapers downloaded from WallGlobe for personal, non-commercial use only. This means you can use them on your personal devices, but you cannot sell them, redistribute them, use them in advertising, or otherwise exploit them commercially.
  • Prohibited Use: You agree not to:
    • Use the Services in any way that violates any applicable federal, state, local, or international law or regulation.
    • Use the Services to transmit any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
    • Attempt to gain unauthorized access to the Services, other users' accounts, or any computer systems or networks connected to the Services.
    • Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
    • Interfere with or disrupt the Services or servers or networks connected to the Services.
    • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Website or any part thereof.
    • Modify, adapt, translate, or create derivative works based upon the Wallpapers or the Services.
    • Remove any copyright, trademark, or other proprietary rights notices contained in or on the Wallpapers or the Services.
    • Use the Wallpapers in a way that suggests an association with or endorsement by WallGlobe without our express written consent.
    • Upload any content that infringes on the intellectual property rights of others.

5. Intellectual Property

  • Ownership: The Wallpapers available on WallGlobe are protected by copyright and other intellectual property laws. WallGlobe and/or its licensors retain all rights, title, and interest in and to the Wallpapers. These Terms do not grant you any ownership rights in the Wallpapers.
  • License: Subject to your compliance with these Terms, WallGlobe grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Wallpapers for personal, non-commercial purposes only.
  • User-Uploaded Content (Optional - Include if you allow user uploads): If you upload any content to the Website, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize WallGlobe to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all such content to enable inclusion and use of the content in the manner contemplated by the Services and these Terms. By uploading content, you grant WallGlobe a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Services and WallGlobe's (and its successors' and affiliates') business.

6. Disclaimer of Warranties

THE SERVICES AND WALLPAPERS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WALLGLOBE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

IN NO EVENT SHALL WALLGLOBE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

8. Indemnification

You agree to defend, indemnify, and hold harmless WallGlobe, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.

9. Modifications to the Terms

WallGlobe reserves the right to modify or replace these Terms at any time. We will post the updated Terms on the Website with a revised "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.

10. Governing Law and Jurisdiction

Any dispute, controversy or claim arising out of or relating to this agreement, including any question regarding its existence, validity or termination, shall be finally submitted to the Hong Kong International Arbitration Centre (HKIAC) for arbitration administered by the HKIAC in accordance with the HKIAC Administered Arbitration Rules in effect at the time of the notice of arbitration. The seat of arbitration shall be the Hong Kong Special Administrative Region. The arbitral proceedings shall be conducted in [Chinese], and the tribunal shall consist of [one]arbitrator. The arbitral award shall be final and binding upon both parties.

11. Entire Agreement

These Terms constitute the entire agreement between you and WallGlobe concerning the Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and WallGlobe with respect to the Services.
